1. Agreement to These Terms
By accessing or using CaptureReel, you agree to these Terms of Service. If you use CaptureReel on behalf of a business, you represent that you have authority to bind that business to these terms.
2. The Service
CaptureReel helps users create short-form promotional videos from product names, images, product URLs, descriptions, and related materials. Generated outputs may include scripts, voiceovers, images, video compositions, captions, and product descriptions.
3. Accounts and Eligibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate account, billing, and contact information and keep it current.
4. User Content
You retain ownership of the product images, product details, URLs, brand assets, and other materials you submit to CaptureReel. You grant CenterSquare Software, LLC a limited license to host, process, modify, and use that content as needed to provide, secure, troubleshoot, and improve the service.
You are responsible for ensuring that you have the rights needed to upload and use any content you submit, including product images, trademarks, logos, product descriptions, and third-party materials.
5. Generated Content
Subject to your compliance with these terms and payment obligations, you may use the completed reels and related generated assets for your business marketing. Generated content may not be unique, and similar outputs may be generated for other users.
You are responsible for reviewing generated content before publishing it. CaptureReel may produce mistakes, including inaccurate product claims, pronunciation errors, or content that needs human editing.
6. Prohibited Uses
You may not use CaptureReel to create, upload, or distribute unlawful, misleading, infringing, harmful, abusive, or deceptive content. You may not interfere with the service, attempt to bypass security or usage limits, reverse engineer the service, or use the service to violate another party's rights.
7. Payments, Trials, and Subscriptions
Paid plans, trials, usage limits, and billing terms are shown at signup or checkout. Fees are billed through our payment processor and are generally non-refundable except where required by law or expressly stated in writing. We may change pricing or plan features prospectively with reasonable notice.
8. Third-Party Services
CaptureReel uses third-party providers for services such as authentication, storage, payment processing, email delivery, AI generation, voice generation, video rendering, analytics, and hosting. Your use of CaptureReel may depend on these providers, and their services may be subject to their own terms and policies.
9. Service Availability and Changes
We may modify, suspend, or discontinue parts of CaptureReel at any time. We do not guarantee uninterrupted availability, delivery times, compatibility with every platform, or that every generated reel will meet your expectations.
10. Disclaimers
CaptureReel is provided "as is" and "as available." To the fullest extent permitted by law, CenterSquare Software, LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, CenterSquare Software, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption. Our total liability for any claim related to the service will not exceed the amount you paid to us for the service in the three months before the event giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless CenterSquare Software, LLC from claims, damages, liabilities, costs, and expenses arising from your use of CaptureReel, your content, your violation of these terms, or your violation of another party's rights.
13. Termination
You may stop using CaptureReel at any time. We may suspend or terminate access if you violate these terms, create risk for the service or other users, fail to pay fees, or use the service in a way that may create legal or operational harm.
14. Governing Law
These terms are governed by the laws of the United States and the applicable laws of the state where CenterSquare Software, LLC is organized, without regard to conflict of law principles.
15. Changes to These Terms
We may update these terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of CaptureReel after changes become effective means you accept the updated terms.
